Overridden by federal law
- Satellite dishes < 1m. FCC OTARD rule (47 CFR ยง 1.4000) preempts HOA bans on dishes you own or have exclusive use of.
- U.S. flag display. Freedom to Display the American Flag Act of 2005. HOAs can regulate size and placement, not the right.
- Religious displays at entryways in HUD-related housing โ and many states extend this further.
- Fair Housing protections. Service animals, reasonable accommodations, family status, disability. The HOA can't override the FHA.
Overridden by state law (varies โ check your state)
- Drought-tolerant / xeriscape landscaping โ CA, NV, AZ, CO, TX, FL and more.
- Native plants and pollinator gardens โ MD, MN, MO, and growing.
- Solar panels. 25+ states have "solar access" laws that void HOA bans.
- EV chargers. CA, CO, FL, HI, MD, NJ, NY, OR, VA and more โ boards can require permits but can't ban.
- Clotheslines. "Right to dry" laws in roughly 20 states.
- Political signs. Many states protect display windows around elections.
- Rainwater collection. CO, OR, others โ protected.
- Religious items on doorposts (mezuzahs, etc.) โ FL, IL, TX, others.
Defective regardless of the rule
- Rules not properly adopted. If the rule isn't in the recorded CC&Rs or properly amended bylaws, the board can't fine on it.
- Selectively enforced rules. If half the street violates and only you get fined, you have an estoppel defense.
- Vague aesthetic standards. "Attractive," "well-maintained," "harmonious" โ extremely hard to enforce against a homeowner who shows up.
- Retroactive rules. A rule passed after you built/planted often can't be applied backwards.
- Rules requiring a hearing the board skipped. Procedural defect = void fine. See fight HOA fines.
